Forensic Services to Law Firms

       If there is the possibility of electronic evidence testimony in your case, it is important to you that your side wins the “dueling experts” game.

 

      You can be sure that their "expert" is going to be a trained police officer (usually retired) or worse yet, a prior police technician who has taken some computer forensic classes offered by a software manufacturer.       Recently there have arisen organizations that offer “certification “ in computer forensics for a fee, a few hours of on-line study, and finally an on-line test. We invite you to examine the course of study that our Examiners completed before they were allowed to be called Reactive Certified Computer Forensic Examiners. HERE. Services to the Civil side of your practice

Civil litigation is not the same old paper chase that it used to be. The big corporate product liability case on the one hand, and the lowly divorce case on the other hand have at least one thing in common ... the information you need to successfully try or defend the case almost always resides on some electronic media someplace.

Corporate litigation frequently is about who knew what, and when did they know it. Memos, e-mails, and spreadsheets may contain the answers you are looking for. Altered or missing memos, e-mails and files can also contain just as many answers. Uncovering which files were deleted or altered, and by whom, is a good indication of culpability. The differences between originals and altered files points to what the perpetrator was attempting to accomplish or hide, and the date stamps tell when the changes were made.

Divorce settlements frequently require information stored on the family's computer. A spouse's attempt to hide assets by deleting or altering files can be easily uncovered by our staff, facilitating the fair distribution of those joint assets.

Services to the Criminal (Defense) Side of your practice

When electronic evidence is at issue, defense attorneys can be out gunned by the prosecution's deep pockets. Frequently, police or prosecutors "inform" you during discovery that they have determined that such and such was on the accused's computer. We recently heard of a child pornography case where discovery resulted in a set of third generation photocopies of the alleged pornographic pictures being presented to the defense as fulfillment of their duty to produce. Eventually the digital media was examined and it was determined that the models were well over 18 years of age. More disturbing, was that the police department's shift schedule was found on the seized computer!

Digital evidence should be treated with the same degree of care as biological evidence, or any other physical evidence, and you have the right to have your own experts examine the evidence from digital media that is in the same pristine condition that it was in when the prosecution's experts initially examined it.
